Limited Robotic Product Warranty

 

We, Mamibot Manufacturing USA INC. (“MAMIBOT”) warrant to the original buyer/purchaser that the MAMIBOT Robotic Products (“Product”), excluding batteries and consumable spare parts, shall be free from defects in material and workmanship for one (1) year, that the batteries of the above mentioned Robotic Products bear a warranty of six (6) months, from the original date of purchase. Except where prohibited by applicable law, this warranty is nontransferable and is limited to the original purchaser. This warranty gives you specific legal rights, and you may also have other rights that vary under local laws. If you are dealing as a consumer this limited warranty does not affect your statutory rights. 

Exclusion

This warranty is conditioned upon proper installation, use and maintenance. This warranty will automatically become null and void and shall not be applicable to any MAMIBOT Product: (a) has not been timely paid for, (b) is not installed and operated in accordance with the current edition of MAMIBOT product specification and USER MANUAL, (c) has been subjected to abnormal stresses and operating conditions, or (d) not bought from authorized sellers, (e) damaged caused by the use of accessories and spare parts, including batteries, that were not manufactured by MAMIBOT, (f) defects resulting from improper maintenance, unauthorized repairs, (g) normal wear and tear (including, without limitation, wear and tear of batteries), (h) defects caused by rough or inappropriate handling or use or damages caused by accident, misuse, neglect, fire, water, lightning or other acts of nature, (i) the fact that the battery has been short-circuited, if the seals of the battery enclosure or the cells are broken or show evidence of tampering or if the battery has been used in equipment other than those for which it has been specified, (j) willful or deliberate damaged, neglect or negligence, (k) any alteration or modification to the Product which has been carried out by you or a third party not authorized by MAMIBOT, (I) any failure to adequately package the Product for transporation, (m) extreme or external causes beyond our reasonable control.   

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE WARRANTIES SET OUT ABOVE ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES OR TERMS AND CONDITIONS, AND ALL WARRANTIES WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING, WITHOUT LIMITATION, ANY WARRANTIES OR TERMS AND CONDITIONS OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT ARE EXPRESSLY DISCLAIMED BY MAMIBOT AND ITS SUPPLIERS. NO OTHER WARRANTIES OR GUARANTEES, WHETHER EXPRESS OR IMPLIED, GIVEN BY ANY PERSON, FIRM OR CORPORATION WITH RESPECT TO THIS PRODUCT SHALL BE BINDING ON MAMIBOT.

Limitation of Liability

Other than obligation to repair or replace as provided above, MAMIBOT shall have no liability for any losses, expenses, or damages as a result of installation,use, inability to use, removal or replacement of any Products. MAMIBOT will not under any circumstances whether as a result of breach of contract, breach of warranty, tort, strict liability or otherwise be liable for consequential, incidental, special or exemplary damages including but not limited to, loss of profits or revenues, loss of any other goods or associated Equipment or damaged to any associated equipment, cost of capital, cost of substitute products, facilities or services, down time cost or claims of claimant's customers. MAMIBOT’s liability on any claim of any kind for any loss or damages arising out of, resulting from or concerning any MAMIBOT product, any aspect of this warranty, or for any products or services furnished here-under shall not exceed the price of the product which gives rise to the claim.

Nothing in this limited warranty limits or excludes MAMIBOT’s liability for death or personal injury caused by negligence, for representations made fraudulently or for any other liability which cannot be limited or excluded by applicable law.

To the maximum extent permitted by applicable law,MAMIBOT’s entire liability shall be limited, at MAMIBOT’s option, to replace or repair the product or refund of the purchased price paid. 

Obtaining of Warranty

Before proceeding your claims to MAMIBOT directly, you have to contact your local sellers or distributors for repair or replacement. In the case of unable to claim for warranty from local sellers or distributors, we would require you to submit below, but not limited to: 
1) Invoices when purchased, 2) descriptions of how, where, and when the problem occured, 3) any other supporting evidences to proof defects or failure of the Products. 
MAMIBOT takes no responsibility and liability to any other extended guarantee by our distributors, dealers, agents or employees.
